Below are five things to consider when you have been in an automobile accident that is not your fault.
- Call the police. A police report can help document your complaints of injury, property damage, and may prevent the other party from denying responsibility for the accident. A traffic or criminal charge can also help in establishing responsibility.
- Seek medical treatment. Seek medical examination as soon as possible and be sure to give the doctor a detailed account of how the accident occurred and any symptoms you may be experiencing. If you cannot see your regular doctor within a couple of days, seeking medical attention at an urgent care center is a good option.
- Do not communicate with insurance adjusters for the other party. If insurance adjusters for the other party arrive at the scene or attempt to contact you, offer no information and refuse to sign any paperwork they provide. Let your attorney handle this communication for you.
- Contact your insurance company. Some insurance companies require that you contact them immediately and report all accidents, whether or not they are your fault. If you fail to do so, the insurance company may refuse to cover the accident or your injuries.
- Contact an attorney. An experienced personal injury attorney can provide you with the guidance you need to understand and protect your rights. The law affords you many tools to use in prosecuting your case, most of which the lay person is unaware. We will be glad to advise you in a free consultation so that you will leave with a better understanding of what to expect from the insurance company and your case.
Remember that these are general suggestions and should you be injured in an accident, we can advise you based on your specific circumstances.
