A crash in a busy downtown usually leaves something behind — footage from a storefront, a signal log, half a dozen people who were stopped and watching. A crash on a Suffolk two-lane frequently leaves none of that. What it leaves is two accounts, some marks on the asphalt that will not last the month, and whoever happened to be driving the other direction.
That matters more in Virginia than it would almost anywhere else, because our courts still treat contributory negligence as a bar rather than a discount. An injured person carrying any part of the fault recovers nothing — not a trimmed award, nothing. When the record is thin, the argument that you were partly to blame gets easier to make and harder to answer, which is the whole reason not to give a recorded statement to an adjuster before speaking to a lawyer.
Which court hears the claim depends on its size — the Suffolk General District Court where the damages are modest, the Circuit Court where they are not. The two run on different timelines and offer different discovery, and that difference is most of what decides whether an insurer would rather pay than face a jury. We have filed in both for decades.
WHAT THE FIRST WEEKS ARE FOR
SUFFOLK BY THE NUMBERS
Virginia DMV figures put Suffolk at 1,707 crashes across 2024. In them, 1,132 people were injured and fourteen were killed. Speed was a factor in 258 of those crashes on its own, accounting for 209 of the injuries.
Suffolk also generally has two years to bring a claim and no more — two years from the date of injury, and two years from the date of death on a wrongful death claim. That deadline does not care whether treatment finished or whether an adjuster ever called back. It sounds generous until you watch it get spent on medical records arriving from three different providers in three different cities while an insurer under no deadline of its own uses the calendar.
And not all of this work involves a vehicle. Falls on someone else’s property, unsafe premises, dog bites, defective products, and injuries at a business that left a known hazard all arrive here too. Same rule, same clock, same reason to call early rather than late.
